Around 11 p.m. Wednesday night, Montgomery County Precinct 4 Deputy Constables responded to the Valero at the intersection of Loop 494 and FM 1314 in Porter to assist another deputy on a traffic stop. When they arrived they learned that

Jessica Barber Gutierrez, 40, of 2610 Foliage Green in Kingwood had stopped in the roadway for no apparent reason. She then proceeded into the Valero parking lot and stopped. The deputies approached her and smelled alcohol on her breath, while noticing obvious signs of impairment. They identified her through her driver’s license. She admitted drinking a beer earlier and taking Prozac and Xanax.

Sgt. Looza noticed something moving the backseat, where he found an 8-month-old baby buried under clothes, boxes, and a skateboard. Sgt. Looza determined the child was alright, and then performed a field sobriety test on Gutierrez which she failed.

A search of the vehicle revealed no baby clothes, milk or diapers for the baby.

Gutierrez was arrest and she and the 8-month-old little girl were transported to the Constable’s Office for booking. Child Protective Services responded and took custody of the child.

Gutierrez also stated she had a 12-year-old child at hope with a new soon to to be 21-year-old roommate. When asked she was not able to recall the roommate’s name.

During the booking process Gutierrez stated she had also been smoking Potpourri which she bought at a local business and did not know it was illegal.

She was transported to Kingwood Regional Hospital for a consensual blood draw and then to the Montgomery County Jail in Conroe. As of this writing, she remains held on a $25,000 bond.

It was her second DWI w/ a Child under 15 charge. She was also convicted of Child Endangerment in 2007 and received Deferred Adjudication. Gutierrez has other criminal convictions on her record as well.

  1. Funny, but I expect a woman on Xanax and Prozak and Potpourri and Beer whose bambini is buried beneath a pile of trash in the trunk of the Trooper to have a happier, some might even say giddy, expression on their face in a booking session.

    I’d have thunk that cocktail combination of intoxicants would cheer you on up but I guess it doesn’t do much to put a smile on your mug (shot). Seems I’ll have to look elsewhere for the answer to personal Nirvana.

  2. I wish there was a way to gain control over the Potpourri…I fail to understand how a substance can be legal to sell but illegal to possess…..once again the man making the money goes free….and the people smoking it are stupid

Besides the womans dui with a child under 15 look at that mess was she living in that car with that baby ? and was that safety seat buckled in because the strap sure looks loose. its sad how women and men can think only of there next DRINK OR TASTE OF A DRUG then to think about the SAFETY OF A CHILD. THIS IS THE TYPE OF MESS THAT CPS NEEDS TO DEAL WITH ……NOT THE PETTY HE SAID SHE SAID CRAP!
